What has changed?

On 1 December 2015, Wales became the first UK country to introduce a soft opt-out system for organ and tissue donation.

The new system will make it easier for people in Wales to become organ donors.

If you haven’t registered a decision to opt-in or opt-out of organ donation, you will be treated as having no objection to being an organ donor. This is called deemed consent.

Your choices

Your choices are:

If you know you want to be a donor then you can:

  • register a decision to be a donor (opt-in) or
  • choose to do nothing and have your consent deemed. By doing nothing you will be treated as having no objection to organ donation.

If you know you don’t want to be a donor, then you can:

  • register a decision not to be a donor (opt-out).

You can change your organ donation decision at any time.

When you register a decision to be an organ donor you can choose to donate all organs and tissues or choose which organs or tissues you wish to donate.

You can register an opt out decision online or by ringing 0300 123 23 23. Calls to this phone line will be answered by the NHS Blood and Transplant Service.

The new law

The Human Transplantation Wales Act 2013 came into effect on 1 December 2015. The Act and details of the legislative processes can be found on the National Assembly for Wales website (external link).

In 2014/15, 14 people died in Wales whilst waiting for an organ transplant, as a donor could not be found.

Who will the system change apply to?

The new law will apply to adults who live and die in Wales.

You will need to live in Wales for 12 months or more and it won’t apply to some adults such as those who may lack mental capacity.
